Western PA Internet Access, Inc. (WPIA) agrees to provide our customers (users), access to the Internet under the terms and conditions below:
Modifications: WPIA reserves the right to modify our terms and conditions at any time. Terms and conditions will be posted on WPIA's website. It shall be the sole responsibilty of the user to review these terms. Use of our service will be deemed acceptance by the user to these terms and conditions. These terms supersede all other written or oral agreements or communications. Waiver or modification of these terms shall only be effective if in writing and executed by an authorized representative of WPIA or by a signed business contract between the user and WPIA. If you do not agree to these terms, contact WPIA and cancel your service IMMEDIATELY!

Internet Content: WPIA has no control over the content on computers on the Internet. WPIA makes no guarantees for accuracy, reliability, decency or legality of the information accessed through the Internet.

User Responsibility: Users shall not utilize WPIA's services or equipment for any unlawful activities. These activities may include, but are not limited to, anything to do with illegal drugs, gambling, prostitution, child pornography, robbery, spreading computer viruses, unauthorized access into private computer systems, disruption of Internet service, unauthorized copying of copyrighted materials, credit card fraud, exporting information in violation of US export laws, or any other unlawful activities. WPIA will fully cooperate with local, state, or federal law enforcement agencies in the investigation of any crime or civil wrongdoing involving WPIA service, equipment, or users.

Users shall not attempt to impersonate others or masqerade their identity by using another IP address.

Users shall not send unsolicted, threatening or harassing e-mail. The use of software to collect e-mail addresses from web sites, news groups, mailing lists or any other sources is prohibited. The inappropriate use of newsgroups and IRC servers is prohibitted.

User is responsible for all use of his or her account. Passwords should be kept private. WPIA shall not be responsible for unauthorized use of your account.

Privacy: WPIA reserves the right to monitor, view or disclose any information stored on or traveling through WPIA equipment. This may include, but is not limited to e-mail and web page content.

Web pages may not contain inappropriate content, such as pornographic, obscene, vulgar, hateful, racial or other objectionable material. WPIA has the sole discretion to determine what may be deemed as inappropriate content, and reserves the right to remove such content and terminate the account, without prior notice.

Online Purchases: Users shall indemnify and hold harmless WPIA from any and all liabilities or claims involving online purchases, including purchases made from "Secure Servers". WPIA warrants no purchases of products or services made via the Internet.

Billing: WPIA billing terms are Automatic Debit from a Checking or Savings account, Visa, Mastercard, Discover, American Express or Invoice Terms. All accounts expire the last day of the month. Accounts activated after the 5th of the month will be prorated.

Credit Cards and Automatic Debit options are processed on the 25th of the month.

Invoices are mailed on the 15th of the month and payment MUST be posted to our accounting system by the last day of the month, unless other arrangements have been made between WPIA and customer.

Any account not paid in full by the last day of the month of that billing cycle will automatically be suspended until payment is made in full.

Returned checks and declined ACH payments are subject to a $20.00 service fee and the account will immediately be suspended until a replacement payment of cash or certified funds is made.

WPIA reserves the right to terminate any past due account without prior notice.

No Refund Policy: This policy is applicable to ALL accounts. There will be no refunds unless the user is unable to access the Internet due to a direct fault of WPIA. Cancellation of an account will be effective at the end of the current paid-up billing cycle. The user will have full access to the Internet until the end of that billing cycle. Immediate termination of an account will only be effective at the specific request of the user.

WPIA reserves the right to delete any account that is fifteen(15) days past due. Account deletion will include removal of any user data files and email. A $10.00 reactivation fee will be applicable to any deleted account before service is restored. WPIA reserves the right to demand prepayment before an account is reactivated.

Termination of service does not release user from liabilty of charges due. The user shall be responsible for all charges, including but not limited to legal fees and court costs, incurred during the collection of past due accounts.

Termination or Refusal of Service: WPIA reserves the right, at it's sole discretion, to terminate any account at any time with or without reason. WPIA also reserves the right to deny service with or without reason.

Non-Transferability: User accounts and the use of WPIA services are not transferable without prior consent from WPIA.

Prohibited Uses: Reselling Internet services or offering any services in direct competion with WPIA without the express written consent of WPIA is strictly forbidden.

Use of WPIA services or equipment to solicit the subscription to any competing online services is strictly prohibitted.

Use of WPIA services or equipment to solicit (direct or indirect) WPIA employees to leave the employment of WPIA or engagement of services of WPIA employees in any manner is strictly prohibitted.

Use of WPIA services or equipment for any unlawful activities is strictly forbidden.

Limitation of Liabilty: The use of WPIA services and the Internet in general is at the user's sole risk. WPIA shall not be responsible for temporary loss of access to the Internet. WPIA services are provided on an "as is" and "as available" basis with no warranties of any kind. Under no circumstances shall WPIA be liable for any damages resulting from the use of WPIA services or equipment, including loss of profits.

Indemnity: The user agrees to indemnify and hold harmless WPIA, it's officers, directors, shareholders, employees, agents and customers from any and all claims, damages, expenses or liabilities, including legal fees, resulting from the use of WPIA services or equipment, whether or not the use of such services or equipment was authorized.

Violation of Terms and Conditions: Violation of any of the terms and conditions described above may result in penalties including, but not limited to the permanent termination of service or criminal and/or civil prosecution.
